Terms of Use for Clients

1. What CheckerFit is and who serves you
CheckerFit is the platform your coach uses to organize your check-ins, calculate your plan and track your progress. It is operated by Roman & Goderich Investment LLC (Florida, USA).
Your coach is the person who serves you. CheckerFit is not your coach, your nutritionist or your doctor. Everything you receive through CheckerFit has been reviewed and approved by your coach before it reaches you.
2. Language
Your coach has chosen the language of this service. By continuing you confirm that you understand it well enough to follow instructions about food and training. If you do not, talk to your coach before continuing; CheckerFit does not translate.
3. Age
You must be 18 or older. If CheckerFit detects that you are a minor, it will block your account and erase your data according to its minors protocol.
4. What data you send and what it is for
You send body photos, weight, measurements, what you eat and how you train and, if you choose to, what you take (supplements, medication or other substances). CheckerFit uses them only to: (a) calculate your plan with standard formulas; (b) produce a first reading that your coach reviews; (c) compare your check-ins over time; (d) generate your reports. The details are in the Privacy Policy and in the consents you accept separately.
CheckerFit does not sell your data and does not use it for advertising.
5. The AI and its limit
The first reading of your photos and data is produced by an artificial intelligence model. It can be wrong. That is why your coach reviews and approves it before you see it. What you receive is your coach’s opinion, not a machine’s.
6. What CheckerFit does not do
CheckerFit does not recommend supplements, drugs, peptides or steroids. If you declare that you take something, it is only recorded so your coach knows. CheckerFit does not diagnose or treat any health condition. If you have a medical condition, an eating disorder or doubts about your health, consult a healthcare professional before following any plan.
7. Your photos
Photos are used to compare your progress. Those that cannot be compared with earlier ones (framing, light, pose) may be refused or grouped separately. You and your coach are responsible for following the capture guides; a bad photo produces a bad reading.
CheckerFit removes the location and device metadata from your photos when it receives them and pixelates irreversibly every face it detects before analyzing and storing them. A photo that cannot be processed this way is not stored at all; you are asked to send it again.
Your photos, and the measurements and physique readings derived from them, are treated as biometric data. Before your first photo you sign a written release for them in your CheckerFit space, by typing your full name. The release states what is collected and stored, the specific purpose (analyzing and comparing your physique for your coach), who receives the photos and how long they are kept, and is recorded with the name you typed, the version of the text, the date and a cryptographic hash of the text you saw. Without it you cannot send photos. You can withdraw it at any time by writing to privacy@checkerfit.com: from then on no new photo is accepted and your photos are destroyed as with an erasure request. CheckerFit never sells, leases or trades biometric data, never uses it to identify you or anyone else, and destroys it according to the schedule in the Privacy Policy.
8. Third-party channels
If you use Discord or another external channel to talk to your coach or receive notices, that channel is run by a third party with its own rules. CheckerFit cannot guarantee what that third party keeps or erase it for you. Your official data and your reports live at checkerfit.com; only there does CheckerFit guarantee complete erasure.
9. Your rights over your data
You can ask at any time for a copy of your data, to correct it, or to erase it: from your account at checkerfit.com where the option is available, or by writing to privacy@checkerfit.com. CheckerFit answers within the time limits in the Privacy Policy. If your coach leaves CheckerFit, your rights do not change: you can still ask CheckerFit directly for your copy or your erasure.
10. Liability
Your coach is responsible for the plans they approve and for their relationship with you. You are responsible for the truthfulness of what you send and for following the instructions or not. CheckerFit is responsible for the platform working: that the calculations follow the documented formula, that your reports reach only you, and that your data is protected with reasonable measures.
To the extent permitted by law, CheckerFit is not liable for injuries, physical results or damages arising from following a plan, because the plan is issued by your coach.
11. Termination
You can stop using CheckerFit whenever you want. If you do, or if your coach removes you, your data follows the retention and erasure schedule in the Privacy Policy, unless you ask for erasure sooner.
12. Governing law
Florida, USA, without prejudice to the consumer and data protection rules of your place of residence that cannot be excluded. The country or state annexes that appear in the Privacy Policy form part of these Terms.
